Franchise Application Form

The estimated initial investment required per franchise location ranges from $364,000.00 to $550,000 for a standard Beyond Juicery + Eatery location. These figures assume existing shopping center locations and do not include ground-up free-standing buildings. A franchisee is responsible for the entire cost including obtaining their own financing. Start-up costs will vary depending on landlord buildout contributions, construction costs, and several other factors. A breakdown of these start-up costs can be provided in the Franchise Disclosure Document (FDD).

A Franchise Agreement is issued for ten (10) years and has a renewable term of an additional ten (10) years. The franchise fee is $30,000 for each store location as of January 1, 2018: To qualify for consideration, prospective franchisees should have a minimum of $200,000 in liquid assets, have a net worth of $500,000 or greater, and have the ability to obtain financing to cover the cost of opening a Beyond Juicery + Eatery franchise location as well as several months of working capital. The royalty fee is currently 6.00% of sales and the marketing fee is currently 2.00% of sales, paid weekly thru ACH.

Acknowledgment

1. All information and materials regarding BJE, including, but not limited to, business plans, financial information, costs
and prices, service charges, recipes, formulas, concepts, ideas, photos, drawings, films, visual and sound recordings,
whether written or oral, disclosed to me or learned by me (hereinafter referred to as the “information”) shall be held by
me in the strictest confidence and shall not, without BJE’s written consent, be disclosed to or permitted access by
anyone.
2. I understand that unauthorized use, alteration or disclosure of information or any portions thereof may, in addition to a
breach of this Agreement, constitute unfair trade practices, unfair competition and/or trademark infringement.
3. I will not compromise BJE’s trademarks, advertising or systems by any action, including, but not limited to,
recommending to other companies or persons that they utilize BJE’s trademarks, advertising or systems in whole or in
part.
4. All information shall remain BJE’s sole and exclusive property, and shall be returned immediately, in their entirety,
including all copies thereof, to BJE’s corporate headquarters in Michigan, upon termination of my relationship with
BJE’s request, whichever first occurs.
5. If I become legally compelled to disclose any of the information, I shall provide BJE with prompt notice of such request
so that BJE may seek a protective order or other appropriate remedy and/or waive compliance with the provisions of
this Agreement. In the event that such protective order or other remedy is not obtained or that BJE waives compliance
with the provisions of this Agreement, I will furnish only that portion of the information which I am legally obligated to
disclose.
6. In connection with my or my spouse’s franchise application consideration by BJE, I understand that investigative
inquiries may be made on myself as to my work habits, performance and experience. Further, I understand that BJE
may use an investigative agency (“Agency”) to request information from various federal, state and other agencies
which maintain records concerning my past activities, criminal history and consumer report information. I authorize,
without reservation, any party or agency contacted by the Agency to furnish the above mentioned information, and I
consent to BJE receiving the above information from the Agency or any of the Agency’s licensed agents. I also
release BJE and the Agency and/or its agents from any claims or liability resulting from the reporting of this
background information. I agree that a copy of this authorization is as valid as the original.
7. If any part of this Agreement is held to be void or unenforceable, the remaining terms and provisions shall remain
valid and enforceable. The covenants, representations and warranties in this Agreement shall survive its termination
and the termination of any business relationship between BJE and me. The terms of this Agreement shall be
governed by, and interpreted under Michigan law.
